Ad regulations
BANNED (real-money). Promotion & Regulation of Online Gaming Act 2025 (signed 22 Aug 2025) prohibits ALL online real-money games — skill and chance — plus their ads and payment processing; up to 3 yrs jail / ₹1 crore fine. Esports and free social games permitted.
LEGAL but UNREGULATED & heavily taxed. Legal to hold/trade; not legal tender. 30% flat tax on gains + 1% TDS per transaction + GST on platform fees; exchanges must register with FIU-IND (AML). RBI remains cautious; no comprehensive framework yet.
RESTRICTED / largely blocked. Publishing/distributing porn is illegal; govt has blocked 60+ porn sites and banned 25+ OTT apps (Jul 2025) for obscene content. IT Rules 2021 mandate age verification and 24h takedown. Adult offers are high-risk and non-compliant on major ad platforms.
ALLOWED. No specific ban; Tinder, Bumble, Indian apps operate freely. Must comply with IT Rules obscenity norms and DPDP Act 2023 data-protection rules; avoid explicit/adult creatives.
RESTRICTED / tightly regulated. RBI (Digital Lending) Directions 2025 (eff. 8 May 2025): only RBI-regulated entities' apps allowed (public DLA directory since 1 Jul 2025), mandatory data localization, direct-to-borrower disbursal, cooling-off period, strict ad vetting; offshore/illegal loan apps actively blocked.
RESTRICTED. Drugs & Magic Remedies (Objectionable Advertisements) Act bans ads claiming cures for listed diseases; FSSAI regulates nutraceuticals as food (no therapeutic/medical claims); prescription-drug DTC ads restricted. ASCI enforcement heavy — 98% of scrutinised ads (FY25-26) needed modification; health/nutra a top violation category.
- Multiple: MeitY & Online Gaming Authority of India (OGAI) for gaming
- RBI for lending/fintech
- FSSAI & CDSCO/DCGI for food/drugs
- ASCI (self-regulatory) & CCPA for advertising
- MIB for OTT/broadcast.
- 2025 was a sharp tightening year: nationwide ban on real-money gaming, RBI digital-lending directions, OTT/adult crackdowns, and DPDP Act data-protection rollout
- Betting/gambling — historically a huge affiliate vertical — is now effectively off-limits.

- Notes

- Peak activity
-
Evenings 7-10 PM are the strongest window; secondary spikes at the 8-9 AM commute and 12-2 PM lunch. Reels/Shorts peak 6-8 PM on weekdays; Wednesday, Friday and Sunday tend to drive the best engagement.🕐 In your time zone (approx.):
- Creative taboos
- Avoid content offensive to religion — cows/beef are sacred to Hindus and dietary/religious references are highly sensitive
- Steer clear of caste references, communal/political framing, disrespect to national symbols or deities, overt sexual content and PDA (still taboo), and LGBTQ+ themes in mainstream mass ads (handle carefully)
- Skin-lightening 'fairness' claims and denigrating darker skin are banned/heavily restricted
- Advertising is self-regulated by ASCI, which polices misleading claims, decency and denigration.
- Also worth knowing
- India is deeply multilingual and price-sensitive: Hindi + English carry pan-India reach, but regional-language content (Tamil, Telugu, Bengali, Marathi, Kannada, etc.) and vernacular short-form video (Reels/Shorts) are essential for scale beyond metros
- Cricket is the near-universal passion and festival seasons (especially Diwali) are the peak shopping and ad-spend windows.
