Ad regulations
BANNED — Total ban on all gambling advertising, sponsorship and promotion since the 2018 Dignity Decree (Decreto Dignità, Law 96/2018), enforced by AGCOM; covers TV, radio, print, web, social, influencers, streaming, SEO/SEM, sponsorships, email/SMS. ADM licenses operators (new remote-licensing regime from Nov 2025, 52 licensees on single master domains). Bonuses may only be described neutrally/informationally, never incentivised.
RESTRICTED — Legal; EU MiCA fully applies. CONSOB + Banca d'Italia authorize CASPs (transitional period ended 30 Dec 2025; 9 entities authorized). Marketing must be fair, clear, non-misleading and consistent with the white paper; CONSOB has formally warned fin-influencers that 'not investment advice' disclaimers do not remove legal liability.
RESTRICTED — Legal but tightly controlled; since 12 Nov 2025 AGCOM mandates robust age verification for adult sites/video-sharing platforms serving Italy (incl. foreign-based). Advertising limited by IAP code and decency rules; no adult ads in mainstream/child-accessible media.
ALLOWED — No specific restriction; standard IAP self-regulation, Consumer Code, GDPR and decency rules apply; misleading or hidden-ad claims policed by AGCM.
RESTRICTED — Consumer credit/loan ads must display transparent APR/TAEG and mandatory disclosures (Consolidated Banking Act, Banca d'Italia transparency rules); investment promotions supervised by CONSOB; misleading financial advertising is sanctioned.
RESTRICTED — Prescription-drug advertising to the public is banned; OTC/SOP medicine ads require prior Ministry of Health approval (AIFA regulates the sector). Food supplements/nutraceuticals are allowed but cannot claim to prevent or cure disease (EU health-claims rules); Ministry of Health can pull misleading or health-risk ads.
- EU frameworks apply (GDPR, Digital Services Act, Unfair Commercial Practices Directive)
- Self-regulation via the IAP Code of Marketing Communication (71st ed.)
- AGCOM 2024-2025 influencer guidelines require clear #adv/#sponsorizzato disclosure
- AGCM fines misleading/hidden advertising (e.g. the Ferragni 'Pandoro-gate' case).

- religion (Catholic sensitivities) and immigration/politics are polarizing
- football-club rivalries are tribal
- gambling messaging is legally and socially sensitive
- be cautious with body-image claims in nutra
- Also worth knowing

- WhatsApp is near-universal (great for CRM/conversational marketing); PayPal and PostePay lead online checkout, Satispay is rising.
- Sharp North-South divide — Milan/North is wealthier and more digital-mature, so segment offers and creatives by region; the audience is heavily mobile but skews old (median ~48).
