Ad regulations

Gambling & betting Restricted

RESTRICTED — state monopoly on most online gambling. Online casino & poker lawful ONLY via state-owned Totalizator Sportowy's 'Total Casino'; private operators may offer only sports betting (zakłady wzajemne) and promotional lotteries under a Ministry of Finance licence. Unlicensed sites are IP/payment-blocked (Register of Prohibited Domains). Betting ads must carry responsible-gambling & licence warnings; flat tax on winnings rising from 10% to 15% in 2026. Gambling Act 2009 (major amendment 2017).

Crypto Restricted

RESTRICTED — legal but in regulatory limbo. Operates under transitional VASP registration; EU MiCA not yet transposed — the President vetoed the Crypto-Assets Market Act (Dec 2025), risking loss of EU passporting after the 1 Jul 2026 deadline. KNF is the designated supervisor once enacted; MiCA marketing rules (fair/clear/non-misleading, risk disclosures, cooling-off) apply to CASPs. High retail adoption.

Adult Restricted

RESTRICTED — pornography legal for adults (18+); explicit ads barred from mainstream/broadcast media and must not target or be accessible to minors. Sex work itself is legal but pimping/brothel-keeping is not. Keep creatives non-explicit — Poland is socially conservative about public sexual content.

Dating Allowed

ALLOWED — legal and unrestricted; standard EU consumer-protection & GDPR rules apply; avoid deceptive/fake-profile funnels. Catholic-conservative norms mean overtly sexual dating creatives underperform and attract scrutiny.

Finance & loans Restricted

RESTRICTED — consumer lenders regulated under the Consumer Credit Act & anti-usury caps on non-interest costs; APR/total-cost (RRSO) disclosure is mandatory. Supervised by KNF (financial supervision) and UOKiK (consumer protection); misleading 'free loan'/hidden-fee claims are penalised. Loans, cards, banking & insurance are strong but compliance-heavy verticals.

Nutra & pharma Restricted

RESTRICTED — advertising prescription-only medicines to the public is BANNED; OTC-medicine ads allowed but regulated (mandatory warnings) under the Pharmaceutical Law, supervised by GIF/URPL. Dietary-supplement ads are legal but under tightening scrutiny (GIS notification, self-regulatory 'supplement ad code', curbs on misleading health claims). No disease-cure claims (EU rules). Note: a June 2025 CJEU ruling struck down Poland's absolute pharmacy-advertising ban.
