Ad regulations
LEGAL — Regulated by the Gaming Commission of Ghana under the Gaming Act 2006 (Act 721); ~90 licensed operators incl. ~23 sports-betting firms across 5 licence classes (casino, sports betting inc. online, route ops, promotional, mobile/interactive). Online & mobile sports betting is hugely popular among young men. 20% tax on Gross Gaming Revenue; the 10% withholding tax on player winnings was REPEALED 2 Apr 2025. Ads must carry 18+ / 'gamble responsibly' / 'gambling is addictive' warnings
RESTRICTED — Legal to trade but NOT legal tender (cedi is the sole official currency). The Virtual Asset Service Providers Act 2025 (Act 1154, passed 19 Dec 2025) sets up BoG (new Virtual Asset Dept)/SEC/FIC licensing for exchanges, wallets & custodians — supervisory rules rolling out in phases through 2026; ~3M+ users. Until licences issue, operate/market with caution
BANNED — Production & distribution of pornography/obscene material is criminalised (Criminal Offences Act). Same-sex conduct is illegal (s.104 'unnatural carnal knowledge'); the Human Sexual Rights & Family Values (anti-LGBTQ+) Bill 2025 (passed Parliament May 2026, awaiting assent) adds penalties for producing/publishing/promoting LGBT content online — treat all LGBT-adjacent creative as high-risk
ALLOWED — Mainstream (heterosexual) dating apps operate freely; large young single population. But any LGBTQ+ dating/content is criminalised & increasingly dangerous under the anti-LGBTQ+ bill; keep all creatives strictly conservative/heterosexual and religion-respectful
RESTRICTED — Bank of Ghana Digital Credit Service Provider licensing: BoG began accepting applications 3 Nov 2025; all unlicensed digital lenders must register by 30 Jun 2026 or face enforcement (min. capital GHS 2M, GHS 10k loan cap, GHS 20k fee). New rules ban harassment, contact-scraping & unauthorised social-media 'shaming'; crackdown on predatory app lenders (50%+/week rates seen). Banks/MFIs supervised by BoG
RESTRICTED — The Food & Drugs Authority (FDA Ghana) PRE-APPROVES all ads for food, drugs, supplements, herbal/homeopathic meds, cosmetics & medical devices (print, outdoor & digital) — nothing runs without clearance. Claims must be scientifically substantiated & non-misleading; no fear/superstition appeals; draft 2025 guidelines ban 'live presenter mentions'.
