Ad regulations

Gambling & betting Restricted

RESTRICTED — Licensed by DGOJ; RD 958/2020 ad decree limited TV/radio gambling ads to 01:00–05:00 and banned welcome bonuses, celebrity endorsements and new-customer digital/social acquisition. April 2024 Supreme Court struck down several of these articles (bonuses, celebrity, blanket digital ban) for lacking statutory basis; 2025 rules add mandatory harm-warning slogans (e.g. 'the probability of being a losing gambler is 75%').

Crypto Restricted

RESTRICTED — CNMV Circular 1/2022 governs crypto-asset ads; mandatory risk warning 'Investment in crypto-assets is not regulated, may not be suitable for retail investors and the full amount invested may be lost'; influencers/experts are 'obliged subjects'; mass campaigns (>100,000 reach) need 10 working-days prior notice to CNMV. EU MiCA now applies.

Adult Legal

LEGAL — Pornography and adult services are legal; broadcast/audiovisual advertising restricted to late-night watershed under the LGCA; 2025 government age-verification pilot ('cartera digital') tightening minor access.
