Ad regulations

Gambling & betting Restricted

RESTRICTED — Regulated province-by-province (24 jurisdictions; no national online licence). 20+ provinces plus CABA (LOTBA) license online betting/casino; large illegal-offshore volume. National ad rules tightened by Resolution 446/2025 (Nov 2025): every gambling ad — including influencer/paid promos — must carry '+18' and 'EL JUEGO COMPULSIVO ES PERJUDICIAL PARA LA SALUD' warnings (>=10% of ad height); criminal complaints filed against influencers pushing illegal sites.

Crypto Legal

LEGAL — Legal to hold and trade (not legal tender); very high retail adoption as an inflation hedge (USDT/stablecoins). VASPs must register with the CNV under Law 27,739 (registration mandatory by 31 Dec 2025) with UIF AML/KYC. President Milei is pro-crypto, but the Feb-2025 $LIBRA memecoin scandal drew scrutiny; BCRA is finalizing a framework to let banks offer crypto (expected 2026).

Adult Legal

LEGAL — Pornography is legal for adults (18+) and sex work itself is not criminalized, but Decree 936/2011 bans advertising of sexual/commercial-sex services ('rubro 59') across all media (anti-trafficking), and promotion of prostitution/brothels is illegal; broadcast decency rules apply.

Dating Allowed

ALLOWED — No sector-specific restriction; mainstream and casual dating apps operate freely under general consumer-protection (Ley 24.240) and data-protection (Ley 25.326, AAIP) rules.

Finance & loans Restricted

RESTRICTED — Banks and consumer credit supervised by the BCRA; ads must disclose the total financial cost (CFT/APR) under consumer-protection and fair-trade law; growing scrutiny of predatory fintech/app lending; interest-free installment schemes (e.g. 'Cuota Simple') are heavily promoted.

Nutra & pharma Restricted

RESTRICTED — ANMAT regulates; Disposition 4059/2025 updated public-facing ad rules for OTC/herbal medicines, foods and dietary supplements — mandatory warnings (supplements: 'SUPLEMENTA DIETAS INSUFICIENTES. CONSULTE A SU MEDICO Y/O FARMACEUTICO'), no false/exaggerated/therapeutic claims, prior scientific substantiation; prescription drugs may not be advertised to the public.

Regulators
  • ANMAT (health, pharma, food & supplements)
  • BCRA & CNV (finance & crypto)
  • UIF/FIU (AML)
  • ENACOM (broadcast/telecom)
  • AAIP (data protection)
Notes
  • No single national advertising regulator — the Ley de Defensa del Consumidor (24.240) and Ley de Lealtad Comercial govern ads, enforced mainly by Defensa del Consumidor
  • Tobacco advertising is heavily restricted (Ley 26.687) and alcohol ads are limited
  • influencer-disclosure practice is emerging
  • Data/privacy under Ley 25.326 (AAIP).

  • Cash (declining; ~16% projected by 2030)

  • e-commerce ~US$33B (2024) rising toward ~US$50B (2027 proj)
  • Mercado Libre dominates
Notes
  • The Mercado Libre / Mercado Pago ecosystem is the commerce backbone
